LIMITATION OF LIABILITY (AUSTRALIA)Provisions of the Trade Practices Act 1974 (Commonwealth) as amended and other State legislation may imply warranties or conditions or impose obligations upon HINTERLAND IT which cannot, in whole or in part, be excluded, restricted or modified. To the extent permitted by law, HINTERLAND IT’s liability (if any) arising out of or in relation to the products or services supplied by HINTERLAND IT shall be limited, as its option, to (a) In the case of products, the replacement or repair of the products or the supply of equivalent products, or the payment of the cost of replacing the products or having the products repaired or of acquiring equivalent products(b) In the case of services, the supply of the services again or the payment of the cost of having the services supplied again. STATUTORY RIGHTS AND EXCLUSIONSCertain legislation including the Trade Practices Act (1974), the Consumer Guarantees Act 1993 and other Commonwealth, State and Territory legislation implies warranties and conditions into consumer contracts. These warranties and conditions exist separately from and are not affected by the warranties referred to in the product warranty card. Subject to such legislation and to the warranties contained in this warranty, all warranties, conditions and liability implied by law are hereby excluded and HINTERLAND IT shall not be liable for any direct or indirect loss or damage of any kind arising from the products or your use of them (including but not limited to loss of profits and incidental or consequential loss or damage). This is NOT an online tutorial service. HINTERLAND IT’S PRIVACY POLICYThe information you provide will be kept confidential and used to support your customer relationship with HINTERLAND IT. HINTERLAND IT will not share your personal information to any outside organisation for its use in marketing or solicitation without your consent. Your information may be shared with agents or contractors of HINTERLAND IT for the purpose of performing services for HINTERLAND IT. For example, if we need to ship something to you, we must share your name and address with a shipping company. We also provide third party agents with the minimum amount of information needed to complete the requested service or transaction. HINTERLAND IT A.B.N. 14 860 403 413 WARRANTY PERIODThis warranty is for the period stated on your sales invoice and from date of purchase, covers both parts and labour, and is applicable only to hardware parts originally purchased from HINTERLAND IT. HINTERLAND IT options and accessories carry a full manufacturer’s return to base warranty (subject to the conditions set out below). WARRANTY CONDITIONS FOR HINTERLAND IT HARDWARE
(a) As a result of an accident, misuse, abuse, or other circumstances beyond HINTERLAND IT control (b) By the use of parts or peripherals not manufactured / supplied by HINTERLAND IT (c) As a result of normal wear and tear (d) By use within an improper operating environment including excessive exposure to sunlight, water or other environmental conditions. This includes operation of equipment in an environment where individual electrical supply and or fixtures are detrimental to the operation of the equipment. (e)By modification of the product (f) By the serial number or warranty seal being removed or defaced (g) As a result of service rendered by anyone other than HINTERLAND IT (h) As a result of the product being operated otherwise than in was originally intended. (a) User related (b) Caused by change in normal settings of the computer (c) Software issues not covered under our standard warranty (a) Any problems relating to the installation of any software packages or; any problems arising from user deletion or modification of any preinstalled software (b) The product has been altered, modified or otherwise interfered with (c) The failure is due to normal wear and tear (d) The product has been negligently used, abused, misused or neglected (e) The Product has been subjected to unusual physical, environmental or electrical stress where physical or electrical connection specifications are exceeded (f) The Product is installed or operated otherwise than in accordance with any instructions specified by HINTERLAND IT (g) Any serial numbers have been removed or defaced; the Product has been serviced by anyone other than a HINTERLAND IT or authorized agent (h) Any HINTERLAND IT product purchased from any unauthorised reseller or sourced through any unauthorised channel (i) The defect or failure is due to parts or peripherals other than those supplied by HINTERLAND IT which have been inserted in or connected to the Product, or (j) The defect or failure is due to any act, default or omission by any person other than HINTERLAND IT, its employees or agents or to events outside the control of HINTERLAND IT including vermin infestation, faulty/fluctuation mains power supply, fire, flood, accident, terrorist attack or any other act of God. (k) Defects resulting from the system being used to access or operate software material or websites that may be regarded as being of adult content in nature, gambling or other unsafe sources. |
